Our general terms and conditions

We missed a lot of good waves while writing the general terms and conditions. If you’re into small-written stuff then take now your time to read the small-written clauses, so that we can later on surf together without problems.

1. Contract stipulation

1.1

In the interest of a homogeneous and harmonious group of participants the operator gives great importance to the respect of the age limit of the participants, when it comes to children or young people. You can book by filling out the online booking form or by sending an e-mail. For the under-18-year-olds the signature of their legal representative or a delegated person is required. The booking is binding on the client when it comes to the operator and the contract comes to effect upon receipt of the corresponding confirmation issued by the operator. The contracting parties for the liability and for the contract stipulation are both the legal representative who makes the booking and the participant. The amount fixed by the operator must be paid directly into the bank account of the operator at least four weeks before departure. If the operator has not yet received the entire amount at the departure date, it is entitled to exclude the participants from the journey at the expense of the person making the booking. This doesn’t exempt the operator from asking for the payment of the entire amount.

2. Services

2.1

The price of the journey includes the services shown on the internet, in the leaflets and flyers. Additional agreements must be confirmed in written form by the operator. The operator can modify the single services if it becomes necessary after the contract stipulation and if the changes don’t compromise the implementation of the services.

3. Withdrawal from the contract by the customer

3.1

The customer may withdraw from the booked trip or modify the booking by means of a written statement. The cancellation fees will be calculated from the travel price starting from the date of receipt of the withdrawal as follows:

• up to 60 days before departure € 50.00
• 59 to 30 days prior to departure - 20% of the camp price
• 29 to 15 days prior to departure - 40% of the camp price
• 14 to 7 days prior to departure - 70% of the camp price
• as of the 6th day prior to departure - 100% of the camp price

Participants are free to prove that the organiser has suffered significantly lower damages than the cancellation fee claimed. Participants are recommended to take out insurance for travel cancellation costs. Until the beginning of the trip the customer may give his/her place to a third person who must be prepared to take on the agreed travel arrangements or the customer can change the booking. In this case the rebooking fee amounts of € 25.00.

4. Cancellation of the contract due to exceptional circumstances

4.1

If the cancellation of the journey was carried out due to circumstances beyond control (for example epidemics, natural disasters, war) or due to reasonable dangers, the operator will refund the amount paid under consideration of its expenses. In case of contained increases in expenses the price may in turn be increased by the appropriate proportionate amount.

5. Exclusion from the journey

5.1

Participants may be definitively excluded from the journey due to undisciplined or dangerous behaviour or if they disturb the course of the journey. Possible expenses for the return flight are chargeable to the participant or to the person who made the booking. The participant is not eligible for the reimbursement of the price of the journey. The liability of the operator and its duty of surveillance will end with the exclusion from the journey.

6. Liability of the operator

6.1

The operator is responsible for the accurate travel preparations, the careful selection and supervision of service providers, the correctness of service-descriptions, and the contractually correct provision of services. The operator is not responsible for accidents, traffic obstacles, delays of the means of transport, the consequent postponement of fixed dates and for any additional costs arising for the participant. If the travel services are not performed in accordance with the terms of the contract, the participant may lay a claim to a remedy, the reduction in the price of the holiday, compensation for non-performance and the notice of cancellation. In this case the organiser must provide a remedy within an appropriate period of time fixed by the participant. This claim must be reported in writing to the operator within one month before the end of the journey, otherwise it expires after six months.

7. Operator

7.1

During the journey the participants are assisted by qualified members of the team. The operator is not responsible for accidents, sickness and loss of personal belongings. The participants must follow the instructions of the members of the team.

9.1

The signature of the legal representative (in case of under-18-year-old persons) or of the delegated person making the booking allows the participants to do sport (for instance swimming, excursions) during the journey. 10. Catering / Board

10.1

Catering / board service is not provided by provider and is not part of the service. All food and drinks have to be purchased / organized by the participant and are left to the participants’ choice.

11. Particular notes

11.1

As the arrival and departure of the guests occur on the same day, it’s possible that the rooms are not available right away as soon as new guests arrive.

12. Additional clauses

12.1

The participant shall himself be responsible for observing the regulations and provisions regarding passport / visa regulations, foreign currency and health issues. The participant is responsible for the damages incurred as a result of the inobservance of these regulations. The operator will try to inform the participant, as well as possible, of the changes to the regulations before departure.

13. Ineffectiveness of single clauses

The ineffectiveness of a single clause of the travel contract or of the general conditions doesn’t mean that the whole travel contract is ineffective.

14. Place of jurisdiction

14.1

The participant may sue the operator only at its seat. The operator must file actions against the participant at his / her place of residence, provided that the action is not directed against fully qualified merchants or persons who have moved their place of residence or usual sojourn to a foreign country after the stipulation of the contract or those whose place of residence or usual sojourn is unknown at the time of the filing of the action or provided that it deals with legal entities of the public law. In these cases the seat of the operator must be considered.
